All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

TERMS AND CONDITIONS FOR CONTACT LENS AND GLASSES PURCHASES
  • We rely on you to provide your most recent prescription information when ordering which will then be validated with your eye care provider.
  • All customers who order replacement contact lenses and/or glasses must have a valid prescription under the applicable provincial, state and/or federal laws.
  • Your order must be for the same contact lenses and/or glasses that you are already successfully wearing. We accept no responsibility for our customers' lack of suitability to wear contact lenses and/or glasses.
  • By completing the online order form you agree and accept that you have not been advised by a doctor not to wear contact lenses and/or glasses, or to stop wearing the prescribed contact lenses and/or glasses.
  • We reserve the right not to supply contact lenses and/or glasses if we feel that the selected lenses/glasses are not in accordance with the specifications provided by your optician or optometrist, or may put you at some risk.
  • By completing the online order form you agree to accept shipment for the selected product, and agree to pay by the method indicated on your order form. Please note, your credit card will be charged at checkout. If for some reason we are unable to fill your order, a full refund will be issued upon request to the card or payment method used at checkout.
  • By completing the online order form you agree and accept that you are the person responsible for the credit card (when a credit card is applicable) and accept responsibility for all charges made on our site with your card.
  • We reserve the right, at our discretion, to charge your credit card if we have shipped you an order, and the invoice is not paid within a reasonable amount of time.
  • A processing fee can be assessed, charged, and paid to WebEyeCare on every order. Processing fees are stated as a separate line in the shopping cart.

We have made every effort to display the dimensions and colors of our products on the Website as accurately as possible. However, we do not warrant that the product descriptions are accurate, complete, reliable, current, or error-free. If a product offered on the Website is not as described, your sole remedy is to return it unused and with the full contents in accordance with our return policy below.

Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Typographical Errors

In the event that a WebEyeCare, Inc product is mistakenly listed at an incorrect price, WebEyeCare, Inc reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. In the event that a WebEyeCare, Inc promotional discount applies a discount exceeding the advertised offer, WebEyeCare, Inc reserves the right to refuse or cancel any orders placed with a discount exceeding the advertised offer. WebEyeCare, Inc reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, WebEyeCare, Inc shall issue a credit to your credit card account in the amount of the incorrect price.

Terms Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by WebEyeCare, Inc without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of New York, without regard to choice of law provisions, and not by the 1980 U.N. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of WebEyeCare, Inc products) shall be in the state or federal courts located in the City of New York, New York. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of WebEyeCare, Inc products) must be commenced within one (1) year after the claim or cause of action arises. Impersonation of others, including a WebEyeCare, Inc or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying WebEyeCare, Inc immediately if you change your mobile telephone number. You may notify WebEyeCare, Inc of a number change by submitting a contact us form on the website. You agree to indemnify WebEyeCare, Inc in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify WebEyeCare Inc if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Access or Delivery to Mobile Network is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of WebEyeCare Inc as control, and WebEyeCare, Inc is not responsible or liable for issues arising from them.

Eligibility

To receive WebEyeCare, Inc text messages, you must be a resident of the United States and 18 years of age or older. WebEyeCare, Inc reserves the right to require you to prove that you are at least 18 years of age.

Changes to Terms and Conditions

WebEyeCare, Inc may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to WebEyeCare, Inc as website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive WebEyeCare, Inc text messages will indicate your acceptance of those changes.

Termination of Text Messaging

WebEyeCare, Inc may suspend or terminate your receipt of WebEyeCare, Inc text messages if WebEyeCare, Inc believes you are in breach of these SMS Terms and Conditions. Your receipt of WebEyeCare, Inc text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. WebEyeCare, Inc reserves the right to modify or discontinue, temporarily or permanently, all or any part of WebEyeCare, Inc text messages, with or without notice.

Communications and Consent to Electronic Notices

You may communicate with WebEyeCare, Inc via e-mail, telephone, and our website. WebEyeCare, Inc may issue notices via these various channels, including by sending an e-mail to an address you provide. You agree that such notice shall have legal effect. You also agree that notices sent by e-mail satisfy any requirement that notices be provided in writing. If you do not agree, do not use WebEyeCare, Inc products or services. You may have the right to withdraw your consent to receive certain electronic communications, and, when required by law, WebEyeCare, Inc will provide you with paper copies upon request. INSURANCE

All insurance claims processed by WebEyeCare are done so as an out-of-network provider. If your insurance provider does not offer reimbursements for out-of-network claims, we will be unable to issue one for you. It is the insured’s responsibility to check the coverage of the vision benefits plan prior to having WebEyeCare submit a claim. Any questions related to what is covered under your vision benefits should be directed to the company offering your insurance plan.

Not all insurance plans have out-of-network benefits. Contact your insurance company to check benefits from out-of-network providers. Missing or incomplete information may result in delay or rejection of payment. Your insurance company will notify you if it needs additional information.

Insurance claim processing/filing fees are non-refundable.

Payment Methods

Apple Pay & Google Pay: Paying via Google or Apple Pay and using the touch or facial authentication method does NOT automatically create an order with WebEyeCare, Inc. Funds for the potential order will be held by your financial institution until the purchase is confirmed by WebEyeCare, Inc. If no purchase is confirmed, the hold on your funds will be released in 7 business days. Credit Card/PayPal/Amazon Pay: Payment method is charged at checkout and an order is placed with WebEyeCare, Inc. When a refund is requested, the funds may take 1 - 3 business days to transfer back to your account or credit card.

Discounts & Promotional Pricing

Only discounts/coupon codes provided by WebEyeCare are applicable to WebEyeCare orders. Discounts are unable to be applied to products set at a manufacturer minimum price. Discounts are unable to be applied to any online only/sale/promotional item. Only one coupon code per order is able to applied. This also applies to redeemed rewards offers.

Rewards Points

Rewards points are able to be earned and redeemed on regular priced products only. Purchases of promotional or online-only sale products are not eligible to earn or redeem rewards points on. Discounts earned with rewards points are unable to be combined with other promotions or sales including subscription order discounts.

Rewards Tiers are calculated based on the amount of points earned in a 12 month period.

Referral Program

WebEyeCare's Referral Program's Refer-a-Friend, Give $20, Get $20 discount is only applicable to first-time customers on purchases of $100 or more. Referral discounts are unable to be applied to “online-only” or promotional prices and cannot be combined with any other coupons, offers, or loyalty points redemptions.

Schedule a Call

Agent or Concierge:
The purpose of these calls is to provide ordering assistance. At no point during these calls will medical advice be provided. When scheduling a call with an agent or concierge consultation, be sure to schedule the call for a time that works best for you within the availability listed. When a call is requested, the representative will attempt to reach out and/or leave a message one time. If the call is not connected and/or the representative is unable to leave a message, an email correspondence may be substituted.

Doctor Consultation:
By scheduling a doctor’s consultation, you agree to share private health information with WebEyeCare in accordance with the site’s Privacy and Terms & Conditions. A doctor’s consultation is not a substitute for an in-person, in-depth vision health exam. You understand & agree that the health information provided at the time of consultation may be the only source of health information used by the medical professionals during the course of the evaluation and treatment and that such professionals may not have access to my full medical record. You understand that it is your duty to inform your ophthalmologist or optometrist of electronic interactions regarding your care that you may have with other healthcare providers.

NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING MEDICAL TREATMENT

Promotional/Sale Pricing

All 'promotional', 'online only', and 'sale' pricing is subject to change without notice. Promotional priced products ordered in succession (Example: Four (4) orders for only one box of lenses each or one order with more than one promotional product) will be treated as multiple promotional orders, cancelled, and refunded back to the payment method provided at checkout. WebEyeCare reserves the right to cancel any order with promotional pricing that was obtained through a third party without the correct total being calculated at checkout due to incorrect order placement. All promotional priced products are indicated as such on the product page.

Promotional priced products are unable to be ordered more than one (1) time in a 100 day period.

Suits You Guarantee

Purchase the "Frame Only" option on any glasses or sunglasses and take advantage of our Suits You Guarantee. Within 14 days of purchase, you can return your glasses frame for a full refund.

The glasses frame, frame case, cleaning cloth, and any other frame accessories must be in like new condition in order to be accepted under the Suits You guarantee. Any returned frames that do not meet these requirements will be subject to our regular glasses refund policy.

Virtual Try-On

WebEyeCare's Virtual Try-On tool is for visual overlay representation of the glasses or sunglasses frame only. The Virtual Try-On is NOT meant to be used as a sizing tool.

Shipping

WebEyeCare offers free shipping on orders $89 or more. Our regular shipping methods are as follows: 5-10 Business Day Ground, 3-7 Business Day Ground, 2nd Business Day Air and Next Business Day Air. Orders to P.O. Boxes are only eligible to ship via USPS ground.

Apart from custom or made to order lenses, orders placed and prescription verified before 12:00 PM Eastern Time will be sent to the warehouse to be packed or ordered from the manufacturer. Orders placed after business hours will be processed the following business day.

Business Hours are defined as Monday thru Friday, 9 AM - 5PM eastern time. It will take 1 – 2 business days for tracking information to generate online. WebEyeCare, Inc. is not responsible for package delays due to weather conditions or other unforeseen, uncontrollable circumstances.

For glasses, because WebEyeCare may use third party suppliers for some product fulfillment, WebEyeCare cannot guarantee that all orders will ship within the aforementioned time periods. Shipping times on glasses will therefore vary and orders may take at least 30 days to arrive. All frames shown as sunglasses will arrive as sunglasses. Glasses orders are only shipped with the prescription lenses ordered. The original manufacturer lenses are not shipped with the purchase.

All orders with photographic proof of delivery from the carrier are unable to be refunded or replaced. WebEyeCare is not responsible for lost or stolen packages.

Replacements for Lost Packages

In the event of an undelivered or lost package without photographic proof of delivery, customers must notify WebEyeCare, Inc within 30 days of the initial shipment date for a replacement request to be considered. Failure to report a lost package within this 30-day timeframe may result in the forfeiture of the right to receive a replacement or refund.

WebEyeCare, Inc will address and resolve any lost package claims as they are received, but cannot guarantee a replacement after the 30-day notification period has passed.

Our glasses lens warranty is able to be purchased up until tracking for the order is available. The warranty is only valid for 1 year for the shipment date. Lens warranties cannot be added to an item once the order has shipped.

Digital Vision Test

WebEyeCare's Digital Vision Test Team is a partner of WebEyeCare, Inc. During the vision test process, you will be asked a series of questions regarding your satisfaction with your current prescription before proceeding with the vision test portion.

A prior prescription OR your prior prescribing doctor's information is required for the vision test results to be authenticated. The Digital Eye Team obtains the contact lens brand information from your prior eye care practitioner as, per Federal Law, WebEyeCare, Inc. can only dispense the same brand of lenses that you are prescribed.

WebEyeCare's Digital Vision Test is NOT recommended for the following users:

  • Users under 18 years of age
  • Users above 55 years of age
  • Users with a visual acuity below 20/16
  • Users with a visual acuity above 20/40
  • Users who have not had a comprehensive in-person eye exam within the last 2 years
  • Users not comfortable with using computers, internet browsers, and smart phones with touch screen display

WebEyeCare, Inc. is unable to change or alter a prescription in any way. Any changes that need to be made to the prescription can only be made by WebEyeCare's Digital Eye Team. The Digital Eye Team can be reached at (866) 314-6941. Digital Vision Tests are non-refundable unless you do not meet the minimum requirements for the online test.

Subscriptions

The Subscription introductory discount rate of 15% off is limited to one offer per household. This offer is subject to change without notice, and shipping costs may apply for orders under the free shipping minimum purchase amount.

All Subscription orders are placed at the current regular price available on WebEyeCare, Inc. If the price of the item changes, the amount of your Subscription order will also change. The Subscription discount is calculated off the current regular price at the time of order or re-order. Other discounts, sales, & loyalty rewards cannot be combined with the Subscription discount.

If a Subscription order cannot be shipped due to an expired prescription, a valid prescription must be provided prior to the Subscription order being shipped.

You can cancel a Subscription free of charge after you have received your first three Subscription orders OR if a 1-year supply of product has been purchased. If the Subscription is canceled before your first re-order, you will be charged a cancellation fee equivalent to the discount received on your first Subscription order. Subscription accounts that cannot be charged the cancellation fee due to an expired or declined payment method will be flagged & unable to re-subscribe.

Prescription Verification

WebEyeCare follows the Fairness to Contact Lens Consumers Act (FCLA) when verifying prescriptions. According to the law, WebEyeCare is required to verify the contact lens prescription for each order before we can process and ship the order. If a customer faxes or emails us a copy of their prescription with all the required information, we will use that prescription to verify the order. If a customer does not provide us with a copy of their prescription we will contact their doctor to verify the prescription. FCLA states that doctors have eight business hours to respond to our verification request. If we do not hear back from the doctor within the eight business hour timeframe, FCLA states that this is to be treated as a passive verification and the order will be deemed to be verified as correct by the doctor and we will proceed to process and ship the order. Orders verified via this method will not be considered for defective returns/exchanges if the order was passively verified incorrectly.

Pupillary Distance (PD) for Eye Glasses

In order to experience the best results, we need your PD measurement, which measures the distance between the center of your pupils. You may either ask your optician to provide your PD during your eye exam, or you may measure it on your own with a tape measure (using millimeters). WebEyeCare makes no warranties as to the effectiveness of self-measuring your PD. If you do not provide WebEyeCare with your PD measurement, we will use an average PD measurement for your glasses. Please ask your optician for more information.

General Returns

PLEASE NOTE: All sales of made-to-order lenses (designated as "Made-To-Order", "Made To Order", "MTO", "XR" and/or "Custom" on our website) are final. No refunds or exchanges for made-to-order lenses will be accepted, other than for defective lenses as determined by the manufacturer (see Defective Lens Returns section below). WebEyeCare will only accept returns of product that is unopened, undamaged, unwritten on, and in original condition. Items purchased more than 365 days ago are ineligible for return. WebEyeCare is unable to accept returns of the 30 packs within 90 packs of lenses. Returns initiated within 60 days of delivery qualify for a store credit or refund. Items returned after 60 days from delivery are only eligible for a store credit. Any lenses returned after 60 days from delivery must have an expiration date that is at least 18 months out.

WebEyeCare is unable to accept returns of items discontinued by the manufacturer.

Product that has been discontinued by the manufacturer will be listed as such on the product page.

Once our Returns Department receives your unopened boxes, we will promptly process your refund or issue a store credit (less shipping charges & restocking fee*). Please note returning products shipped under a free shipping promotion will result in charge back of the free shipping. If the shipping carrier is unable to deliver the package due to no one being present, shipment refusal, or an invalid/incorrect address and the order is sent back to WebEyeCare by the shipping carrier, an additional shipping charge will be assessed to the order. The same terms apply to orders that exceed the UPS hold time limit and are returned to WebEyeCare.

Defective Lens Returns:

We guarantee that all of our lenses are factory sealed. If you have a problem with any lens purchased from us, please remove the lens immediately. We warranty all lenses for 90 days after purchase. If you suspect that your lenses are defective, please contact us immediately to arrange to return the lenses to us to see if they are defective. In order to determine if lenses are defective we require at least 5 lenses returned from a 6 pack, 25 lenses to be returned from a 30 pack, or 85 lenses to be returned from a 90 pack. If your lenses are determined to be defective by the manufacturer, we will issue a store credit in full. Orders verified in accordance with the FCLA as detailed in the Prescription Verification section above will not be considered for defective returns/exchanges if the order was passively verified incorrectly.

Exchanges:

If your prescription changes, we will exchange unexpired (expiration date at least 18 months out), unopened, and undamaged boxes of contacts within 60 days of your purchase date. If your exchange will be for a higher dollar amount from your original purchase, you will be billed for the difference at the point of processing the exchange. If for any reason your account cannot be billed, your exchange will be placed on hold until the balance is paid in full. For the avoidance of doubt, the prior statement only applies to contact lenses. Any prescription glasses lenses made from an Rx more than 2 years old will be subject to the full charge of the remake lens options.

When Returning or Exchanging Items:

1. Call (888) 536-7480 or email info@webeyecare.com to let us know which items you want to return or exchange. We will then email you a Return/Exchange Form.

2. Secure your merchandise in the original packaging or in a sturdy box to avoid damage. Glasses should be placed in their original case with the cleaning cloth. Please DO NOT return contact lens boxes or glasses in an envelope or any other flat pack. Products received with improper packaging will not receive credit, will be returned, and shipping charges will be incurred. Customers are responsible for the return postage unless the reason for return or exchange was caused by a WebEyeCare error.

3. Please enclose your completed Return/Exchange form and clearly state if you wish to Return OR Exchange your item.

4. Return the item by regular post to:

That's it! Please allow 2-3 weeks for your store credit, refund or exchange to be processed.
